DWI Question?




Hello All,

AH got DWI and had his license revoked. Is our car insurance still valid since his license is revoked? I just thought of this today. He is the primary insurance holder and all cars are registered to him. (I am in NY). He was arrained, not tried yet.

Any experieces out there, please share.

I don't know what state you are in. Usually they can not cancel your car insurance because cars that are not driven or sitting in your yard have to be insured and registered. It just can not be driven him. I hope this helps. Call your sheriffs Dept and ask just in case I'm wrong.

My hubby got a DUI and our insurance company did revoke our privilages.  There are only a few companies that will allow you to carry insurance without paying the SR-22 rate.  Direct Insurance is one of them you can sign a waiver stating that you will not allow your hubby to drive and he will not be covered under insurance.  then when he can reinstate his license you can place him back on the plan with SR-22 insurance.  You need to just call your insurance provider to see what they might offer.

I don't know if you can do this at this point (after the fact), but can you go ahead and change the information at the insurance company into YOUR name only, and take his vehicle off of the policy?  This way, maybe you can avoid having to pay the consequences yourself for what he did.  For me, I had the insurance in my name to begin with, so when my AH got a dui, it didn't affect our policy.  We even could still have his vehicle insured.  He had his license taken away for 3 years, which will be up this Jan., and once that happens, he will have to be put on SR22.  I think he will be on his own separate insurance, not on our plan, so it won't affect MY auto insurance.  For some reason, when he got the dui's, it didn't "register" with our policy, so our payment never changed, even with his truck still on it.  I'm not really sure how that works, but I was glad it didn't affect it!

It's a good idea to check, but depends on your insurance company, this wasn't the case in my case. I had my own policy in my own name, he had his own policy in his own name with a different company (we'd recently gotten married when he got the DUI and hadn't gotten around to changing the policies yet, and after that point I didn't want to), and lo my company cancelled my policy even though he wasn't on it and he never ever drives my car (which is also in my name only) because he's a (albeit restricted) licensed driver living in my house. So now I'm on his policy, and next time this happens he's on his own.
