It's time to file for divorce


I have decided it's time, I hope that moving to a different county this month won't affect my ability to file.  I don't really have the money but I SO want to be done!!!  Hey QOD...can I borrow a grand to pay for a lawyer? LOL...  Really I am going to have to file on my own and have no idea what I'm doing and there's no legal aid available here for civil stuff.  Soooooo I am going to the library getting the forms and I'm just gonna wing it and hope the judge is nice to me.  My only concern is the custody of my son, there are no assets only debts, his debts and he can't really fight from a jail cell to this is a prime opportunity.  I know where he is, I can have him served easily, he can't fight it and it will be done.  I just need to get over my disgust at the thought of him with somone else and hope he finds a nice girl like me who will be really good to my kids if they EVER visit him because he's not worth a $#!^!

Hey Carolinagirl - Hmmm - I would gladly loan ya the dough. Do ya take credit card? LOL

I was just thinking about something that I had found out here in VA while I was researching divorce. I don't know what the laws are there for you but may be worth looking into. I believe (if memory serves me right) that if a spouse lands his butt in jail and is sentence for 1 year, it is an automatic divorce for the spouse not in jail, if that person so desires it. There is no fighting against it from the jailed spouse. But I could have my info mixed up. I just know that in the back of my mind, I think that if my AH lands in jail for a year, I will be divorced - no problems. Research that. It may save you A LOT of trouble. And you are smart about going to the library for your forms and check out the court systems too. I know you can do all of the leg work yourself and just pay the courts for filing fees. No need in paying a lawyer to do that leg work if you are willing to go at it yourself. Just take your time sifting through all of the data so you don't miss something important. - Good luck to ya. :)

Just a heads up: Check your laws carefully, generally there is a residency and a venue requirement. For example, you and/or your spouse (depending on the language in the statute) must have lived in the state for ___ # of months, and the county in which you want to file for ___ # of months. You will not be able to file until you meet those requirements, whatever they might be. Good luck!!
