whats the difference btwn Domestic Abuse & Assault and Battery?

Brother was charged with Assault & Battery. Mother thinks it should have been Domestic Abuse and will go back to the lawyer to see if she can lessen the charges. Whats the difference?


She does remember being told by the police that its going as A&B but she wasnt thinking clearly.

Is the difference btwn Assault & Battery and Domestic Abuse the same as difference btwn Felony and Misdemeanor? and a Misdemeanor can go off your record after so many years but a Felony is on your record for life?

As far as I know assault & battery is the actual crime, and domestic violence is just a description of assault & battery happening in the home.

State laws vary, but doemstic abuse or violence is usually charged when the perpetrator is a member or former member of the household.

Hello Barbara,


I still am wondering if these charges do involve a disabled or elderly person it makes them a felony. You can call your states attorney's office and someone there can help you with the information I believe. cdb
